Hello House. please I need candid advise on this issue. I paid a merchant in China for goods using paypal invoice, this payment was done from my USA Paypal account . The payment was confirmed by my merchant and the goods were shipped. The problem now is that none of the goods were delivered. Tracking number shows that the goods never arrived Nigeria where they were meant to be delivered. Now, the merchant is refusing to refund or replace the missing items saying that I didn't purchase insurance on the shipment. They referred me to their terms and conditions which actually states that shipment is at buyers' risk, buyers bear responsibility for whatever happens during shipment and that when buyer fails to purchase insurance for shipment, no compensation will be made in the event of missing package. I didn't buy any insurance for the shipment. As a result of this, the merchant has refused to replace the missing shipment. I actually find this policy obnoxious because it was seller that entered into a contract with the shipping company. My question are thus:

1) What are my chances of getting back my payment if I file a PayPal dispute on the transactions

2) will seller shipment policy affect my chances of getting back my money using PayPal dispute in any way?

3) Does the fact that the goods were shipped to an address different from the address of the PayPal account that made the payment affect me? I just want to be sure of my chances. Thanks.

what does the tracking number shows as delivered address , place?

Things sometimes disappear in Nigeria as far as I know.

why don't you ismply just file the dispute and see what happens?
 
I already filed the dispute. Seller has now responded saying that I didn't pay for shipping insurance as stated on sellers website. They are now offering me half compensation. That's 50 percent of my amount paid for the item..
 
The shipping company is Singapore post. They are notorious for losing people's packages.


The tracking numbers show 'dispatched to overseas country' that's been the status for the past 2 months plus.

Singapore Post confirmed to my seller that item had been lost .
 
Why would you ship to Nigeria without insurance? You wouldn't send important documents to Nigeria or any development country without it being courier delivery. The seller has offered you possibly the margin he was making on the sale as good will. Live and learn and chalk it down to experience. Not sure why you are complaining. You are lucky seller is being generous. Customs in Nigeria maybe kept goods on arrival...lol. What did you ship anyway?
 
The goods did not arrive Nigeria I'm sure of that. Another thing is that registered mail doesn't pass through customs in Nigeria I have shipped many packages to Nigeria before through registered mail They don't pass through customs. The tracking numbers show that Singapore post didn't deliver them to Nigeria 2 of the tracking numbers were even deleted from their website few days after packages were shipped The problem is not with Nigeria. The problem is between supplier and Singapore post.
 
How where goods to be sent by ship or air? International deliveries can be handed between multiple carriers. You say the tracking number did not show they were delivered to Nigeria. Where was last location on tracking then?

Don't know what to say. However if you get back 50% of your outlay and you pursue the tracking issued directly with Singapore post then perhaps you can finish up making a profit..lol. The goods are somewhere so ask Singapore post directly to help. It happened to me before when I ordered tools and they got lost in post. I tracked them down directly with post and got back tools and my money from seller.
 
I tried contacting Singapore post, they said I can't contact them because I wasn't the one who entered into a contract with them.. They said only the seller can contact them. I'm also aware that in cases like this, if located,, the goods are normally returned to the sender. So it is almost impossible for me to get the goods
 
How were the goods shipped by air or ship?
 
hi i ordered a watch on 5th june,recieved it 14days later,it has not worked from day one.paid in full by paypal, i have emailed the company 4 times with no reply..i have asked for a refund..hope that you can resolve this matter..thank you
