My questions is more like about litigation and legal thing about corp. structure.
If an online business is legal in many developed countries but not so legal in home country, then is it possible for operator to create corp. and the business and provide it to only legal countries worldwide? and block the home country.
So how this way works in long term? How they get money in hand in home country?
And from the litigation perspective what would the future outcomes of this structure?

For example: Adult business is legal in many developed countries like US, EU if done properly. But its illegal in China or Russia. So if a chinese person opens an adult business for only foreigners worldwide, then what should the corp. structure of it?

Note: this question is for only educational purposes.

And what should the business structure be? Like if a court order in China request info from US hostings or domain companies, should they obligate to respond?

Nope. They don't have to shut down your website. If your business is legal in US, it doesn't have problem with them.

However, your local police could arrest you if they realize your business.

For example, my homeland is the first country which started internet censorship. Its purpose was blocking porn website such as playboy.

Every adult websites were banned by government and domestic porn website owners were arrested even if they used US or EU hosting to avoid police investigation. If they escaped to other countries, the authorities cancled their passports to pressure them to return.

So what I want to say is 'not recommended'. But if you want to do business like that, changing your nationality is the wisest choice.

As you said they were domestic website owners, so what about foreign websites that focuses only foreign people like just US and EU customers? Is that still not legal?
And the offshore corp. structure of it?

Of course still illegal.

Even if you focus on foreigners, it's still a risky business. It doesn't matter where your company is.

So this also means if the owner of Pornhub would visit China or Russia, he will be arrested. What a dumbest thinking...
People create offshore corp.s for these purposes like you see on this board on other threads.

You can do business where it is legal and get hosting the same place and no one will ever shut you down unless you act against international laws.

yeah but what about the banking and taxes & company part?
bcz if you receive money into the foreign bank account then it might be get attention from foreign tax authority or bank and maybe report your earnings to local?
i mean hosting & domain part is easy bcz you can easily obtain a US or Netherlands domain or hosting, what problematic is getting payments part to your home country.

taxes you will have to pay as long as the entire thing is in your name. It can differ depending on where you live but should you live within the EU you will get reported by any bank you may open an account with and have to pay tax from what you earn there. Unless you can proof that your business is setup and managed in a particular jurisdiction / country and your tax office believe you.
