Hi!
We have a non-resident US LLC with 2 partners (so it is not a disregarded entity). We have been trying to set up the adsense account but it seems it is not possible with this company.
Either it is possible to choose: the company is not registered in the US or that it is a US entity.
The goal is to submit the W-8Ben-E. However, it is only possible for companies with one owner.
When choosing the US entity, it automatically presumes we are the tax payers in the USA.

We don't want to have any issues in the future with the IRS. Did anyone have the same problem before? How did you solve it?

Would appreciate any recommendations.
 
Multi-member LLC means it will be a partnership by default, so you need to file partnership returns.

You are not necessarily liable for any tax without ECI, but you need to fill out W-9s in this case. The W8-BEN-E is (with US entities) only for disregarded entities, where you are the direct owner.

that is the problem. After completing W-9 form, adsense requests to confirm that the youtube channel is not subject to withholding taxes as a US person and requests to sign the application by the US person. In reality the channel has to be subject to 30% witholding tax and by finalizing the W-9 form we are afraid we will have troubles with IRS in the future.
