EU citizen preparing to exit

Hello,
I'm currently in germany with no company no contract or whatever as i made myself a break for nearly 2 years to find out the next steps i would like to do.

So the ideal planning is a bit hard because i have a family with childrens who are still going to school.
So my wife and my children would like to move out of germany to czech republic as my wife comes from there and our rest of family lives there so our children could finish their school and get their diploma which still takes 3 more years.

Myself i love the option with Mauritius to get there a residency for my family and myself as its very easy for europeans.
I plan opening a new company in India where i will hire people and an office who will work for me as shareholder and one of the directors (who can be non resident) so my offical income would be from india which would be 3 years tax free via india startup program.
I noticed many companies working in india are located in Mauritius.
The advantage i see for Mauritius is the option to get their citizenship after 3/5 years which i consider highly valueble,
that income from foreign companies are tax free , that money spent via foreign cc is tax free in Mauritius,
and that the location is a financial HUB for Africa which surly will open new opportunities in the future.
Of course there are many other advantages but they are less important.

The negative aspect is that i want to be as much as possible with my children in czech republic till they finish school or till the situation in the EU gets to hot.
Travel cost to Mauritius are way higher than to Dubai,Switzerland,Andorra etc .

What would you think about this kind of setup and do you think german tax department could claim future taxes based on my wife and children still living in the EU and myself only offical in Mauritius where i would still stay nearly 6 months a year with my family within the EU ?

Locations like Switzerland,Dubai,Cyrpus,Malta are no options for me as i consider them unsafe

Yes, because your main center of vital interests will remain in the EU. You will have a hard time convincing a judge of the contrary, and it will cost you a lot in terms of time, stress and legal fees.

They simply don't want to and don't see the need for it including my wife.Thats the biggest stress factor for me.

Did you consider sending your kids to a school in a third country, for example the UK? Which is also very well connected to Mauritius.

if you break your ties with Germany then I don't see why they would care

technically speaking Czech tax office should care and they still don't have DTT with Mauritius as far as I know which can cause theoretically some trouble
yet CZ is nothing like France or Spain... so in case you don't mind being in a grey zone for now they will let you be

The deciding factor in many of these situations will be where your children actually live and where they go to school - if they live and go to school in another EU country outside of Germany, then they - and you indirectly- won't be considered a resident of Germany unless you have other strong ties there.

If you have a company, real estate, other family etc. in Germany, you should cut it. For your residency status specifically, if you plan to be 6 months in Mauritius and 6 months in Czechia, you should research how this is handled exactly in the tax laws of these countries. And you may be considered a tax resident of both countries. Germany should be out of the picture though if you really don't plan to live there.

Wait 3 years then move as a family and keep things simple. Between now an then hopefully Germany does not make it impossible to exit without exit taxation etc or some sort of continued financial reporting if you move abroad - till the day you die.

Saying that a lot of developing country migrants I know leave their wife and kids behind in order to build a better life abroad and call for them when settled. It should be no different for Europeans I guess. And in my book it is always better taking the risk for a better future that sitting still and slowly dying inside.

Anyway Mauritius is a good choice as its considered the gateway to Africa and has a huge amount of DTA agreements to support this.

No they won't go somewhere else currently other than czech republic

I fear not having 3 years anymore and do not want to exit when the s**t is already going down as it will be way harder for sure





So i will high probably also add these options to secure myself more by

1.Sending a seperation letter from a lawyer to my wife (In germany this is enough to declare not being a unit anymore even legaly you don't get divorced and it only works for germany)

2.Leaving majority of income in the indian company over the next 3 years which is an own entity so that money would not be taxable anyways

3.Maybe adding a foundation as owner of the indian company which goal it is to support my childrens lifes .Only question would be if me being the administrator would cause a problem.

if this is your serious concern then better find out thoroughly how Mauritian government managed the covid episode and think twice before choosing the island to be your permanent base

if you truly believe something similar can happen again and it's a inconsiderable part of your planning then Asia (which Mauritius is technically and culturally part of rather then Africa) is probably not the right place

btw I strongly believe that Czech republic would be way more relaxed place for the next "pandemic" then most of the places in the world

Hi! I understand perfectly your worries and your dissatisfaction on the direction Europe has taken. I agree Germany is unsafe (I would never ever want my kids to grow up there) and, even thought Eastern Europe is 10 years behind in the madness, it is just a matter of time. Migration, "diversity", vaccines will be coming there too.
The main difference I have with you is that I am much more focused on a country where I can get the citizenship (in my optinion, for us Europeans residence is easy, taxation is relatively easy, citizenship is hard). If you can, please share some links on the citizenship by naturalization program of Mauritius. I am especially interested in the "ties to the nation" requirements (owning property necessary Y/N, spending more than 183 days/year Y/N, paying some taxes there Y/N, proving that you actually contributing to the development of the country Y/N etc). Thx

You might very likely still be considered resident for tax purposes. Check the rulings regarding § 8/9 Abgabenordnung.

So residency is very easy for Mauritius
You just need to book a ticket ,proof $35k in your bank account and an appartment you are going to rent there ,income from outside Mauritius and you basicly have your residency.
For citizenship you need offically to be 5 years having your living center there OR after 3 years if you spend $375k like for buying a real estate you can apply for citizenship 2 years earlier.
What majority doesn't know is Mauritius has also a Non Dom like Cyprus thats why its so attractive too.
Taxes are zero if you make them from a company outside of Mauritus.

The only negative aspect is the high travel cost and time from europe as its nearly always the same price even if you fly from UAE even the distance is only the half.
Cost of living is also not cheap compared to other locations but of course not more expensive like Dubai ,Bahrain or Qatar.
They had also strict Covid rules BUT from the experience a friend of mine had you can always talk to a local doctor for special treatments and of course there are no mRNA.
Mauritus will use BRICS currency which means it will avoid the high inflation and supply bottleneck in the future

If you want to avoid German taxation, you must be able to document both the termination of your residence (§8) and the absence of habitual stay (§9) in the country. The German tax authorities are thorough and conservative, so proper documentation and consistent behavior are key.
