Question About CBI Eligibility with Prior U.S. Visa Overstay

One of my brother is interested in obtaining a second passport from a one of the Caribbean country, primarily for tax optimization purposes. However, he previously entered the U.S. on a tourist visa, applied for asylum, and was denied. As a result, he was issued a removal order and overstayed his visa by default. Aside from this immigration issue, he has no criminal record. Has anyone with a similar background ever successfully applied for and been granted a CBI passport?
