I just want to share my expirience with the Costa Rica lawyer who incorporated my company there. We applied for a gambling license last year and got it without any problems at all! Now I need a hosting company, bank account and merchant account to get started with my Online Casino.


Everyone else looking for a great and inexpensive solution to get a online casino / gambling license should start to incorporate a company in Costa Rica PM me if you need to know which lawyer I had success with :cool:

You will get it difficut to find any bank or merchant account provider accepting your business even if you have a clean website.
 
Yes it is still valid our is! OffshoreInc, you are right it is hard to find any payment processing for my CR company do you know why it is so?


I have signed up with Liberty Reserve and UKash but still I would love to find a other solution.

It is permitted for businesses to conduct this activity in Costa Rica but you will need:

These gambling corporations work under a commercial license which can be obtained; Slogold will register the corporation and obtain the permits in all governmental institutions required, and fulfill any other specific requirement.


Once this is done we obtain the legal gambling license in the name of the corporation so the client is sure that his company will have no impediments to develop the intended objective.


Having a gambling license also helps corporations reach intended objectives without impediments along the way. To this end, most corporations set up in Costa Rica obtain a license.


In order to create a corporation in Costa Rica that will allow for licensing, it must deal in network administration or internet administration. All internet addresses from Costa Rica must be blocked from the server, since it is Costa Rica's strict policy that none of their citizens participate in online gambling. One must also create an offshore merchant account to deal with the transactions.


Due to the lack of legislation and oversight for online gambling, companies based in or registered through Costa Rica are not subject to monitoring or other regulations that many offshore companies are. This also means that since there isn't a body to govern gambling, companies are self-regulated and aren't required to pay betting or gaming tax.
 
Service providers offering you a Costa Rican gambling license are simply trying to "scam" you to pay a lot of money for nothing. There is no gambling licensing, you get no licence, period.


No license in Costa Rica is required. All you need to do is incorporate, which cost $200-500 and no annual renewal costs other than a cultural tax that costs about $30.


Anyone who claims to have acquired one, scan and post it here. You either have something that is completely fraudulent, or you have nothing more than a Personería Jurídica, which costs about $10 from the Registro de Propriedad after setting up your corporation (and here is valid only for 30-60 days), or you have a general Municipal business license, which likely costs about the same.

Costa Rica has no policy about allowing or disallowing Costa Rican citizens to gamble online, so this service provider you copied above is just making this s**t up. If you don't get it, Costa Rica has no laws what-so-ever regarding online gambling. Some providers operating in Costa Rica choose not to accept Costa Rican customers do to their own risk management decisions, and others do accept them. Poker Stars (openly operating from Costa Rica and licensed in Isle of Man) not only accepts Costa Rican citizens but actively markets to them, and has Costa Rican professionals (such as Humberto Brenes) on their "team".

I've been trying to PM people including the Admin to get more information about setting a company in Costa Rica but for some reason I can't PM no one, when I tried it says I'm not allowed to. Basically all I need is a good reference of someone who can create my company in Costa Rica, and guidance in regards payment solutions such as business bank accounts and merchants accounts. My business is also internet gambling related.

Actually we do not operate in Costa Rica so we will be unable to help, I know there has been a few CR Lawyers posting for some time here on the forum, you may do a search.

Thanks for the reply. Since you do not operate in CR which locations do you operate and which would you recommend for the settled purpose of online gaming without counting with these countries which ask ridiculous amounts of money for remote gaming licences.

We are not serving such industry at all but only reffer to Malta which ask for these "ridiculous amounts of money" - If it isn't a real organisation/company with staff etc. you are representing my best suggestion would be to look for a solution in Costa Rica. I will try to ping a few of the CR lawyers I know of to join for your and further reference and alternative post their details here.

As I dig more into this I find it that the gambling industry is becoming more and more descriminated by governments, associations etc. Not just that but also the fact that to open a gambling site online there are way too many obstacles to climb incluing, charges, checks not even to mention the ridiculous prices companies/professionals are asking to build the gaming softwares. Perhaps not too naive to say that unless you know other ways, and have some knwoledge in certain areas you better be packed up with thousands of dollars (well over 100K to keep it to the minimum) in order just to kick it off and yet there's no guarantees everything will be certainly achieved.


There is obviously a reason for that, but I just don't understand why the general common sense is that anything to do with gambling needs to be illegal, or criminal or any other derogatory connotation and there are so many worse things going on in the world that no one cares or do anything about it. Only play who wants to play. This gaming responsability propraganda is only a distraction to the issue. There's millions of people addicted to alchool, smoke, poisoning food etc and governments do nothing about it. I guess we all know why.


Anyway we are a real company and we believe the gambling industry should be seen as a legit business like any other as long as it is run fairly. We have built our software for just over $4,000 and it runs better, looks better and it is as safe as any top online software you can name it in the industry today. That is why we also believe a gambling licence for the amounts some governments ask is an absurd.


I appreciate the info given and will look into CR and other areas. I think the next step is "how to legally create your own gaming licence." I'm sure there's a way :)

that's a good question would like to know this as well! It seems there is lots of confusion about what Costa Rica actually is offering in regards to gamlbing activities.
 
There are 3 groups of countries in regards to gambling online legislation as follows:


1) Offer Gambling Licences and allow online gambling activity inland. ( These are regulated by agencies and cost thousands of dollars).


2) Do not offer Gambling Licences and do not allow online gambling inland. (Running in there is grounds for criminal persecution)


3) Do no offer Gambling Licences but allow online gambling inland. (Self regulated companies and cheap commerce licence registration)


Costa Rica falls in the 3rd. Although there is no online gambling commision and no specific gambling licences are issued (which means online gambling companies are self regulated in CR) yet the government does not prohibit online businesses to run in CR territory (servers) as long as:


a) Cost Rica's IP addresses are blocked so no CR citizens can gamble on CR based online gambling games.


b) The company is registered with ministery of commerce and holds a merchant number including tax number and obviously pays its taxes (5% only).


c) The company has a physicall address (Residen Agent) in CR for communication and legal purposes and also has a personal representation (Director or Lawyer).


d) The company has an offshore bank account since it is illegal to collect monies in CR from online gambling.


As long as you have all these there is no impediments whatsoever to run an online gambling business in CR.


Hope that clarifies the difference between CR and the rest of the globe :)

That's one interesting thread, even if I'm not into any gambling I was considering Costa Rica for other business reasons. Do they at all have any laws in CR?
